The startup law (Law 28/2022) has set a milestone in creating a more accessible legal framework for digital nomads in Spain. This advancement not only positions Spain as an attractive destination for global talent but also offers a set of benefits that facilitate their integration and stay.

The digital nomad visa, introduced by this law, is specifically designed for those who work remotely for companies located outside of Spain. This visa allows applicants to reside and work in the country for a period of up to five years, depending on their employment situation.

• Territorial flexibility: It allows residents to live and work from any point within the national territory.
• Simplified procedures:
  • The application is made through a one-stop shop at any public registry in Spain, streamlining bureaucratic processes.
  • The centralization of the processing of authorizations in a specialized unit, the UGE.
• Reduced resolution times: consulates have a maximum of 10 working days to issue the visa, while residence authorizations are resolved within 20 working days.
• Accessible fees: During the process, it will be necessary to pay the fee using form 790 code 038, the amount of which currently varies depending on whether it is a first application (€89.96) or a renewal (€95.27).

In addition to these administrative facilities, the regulation includes a package of fiscal incentives designed to attract international talent:

• Digital nomads can benefit from the special tax regime for displaced workers, which allows them to be taxed as non-residents during the first years of their stay in Spain, with a reduced fixed IRPF rate.
• This benefit also extends to direct family members, who can accompany the main applicant under the same tax conditions.
